Smoking rules in the workplace
When it comes to smoking in the workplace, there are quite a few regulations you need to be aware of. Here, we cover what applies and what your rights are.
Can you smoke at work?
According to the Law on Tobacco and Similar Products, which aims to protect people from the harmful effects of tobacco smoke, there are strict regulations regarding smoking in workplaces. The law bans smoking indoors at workplaces to create a smoke-free environment. This means that employees are not allowed to smoke in workspaces or other indoor areas accessible to colleagues.
For workplaces that have outdoor areas, employers may allow smoking there, but it is common for employers to impose restrictions or completely ban smoking outdoors on the premises to promote a healthy working environment. In addition, employers should ensure that no one is exposed to secondhand smoke at work, reinforcing the requirement for smoke-free environments.
Employers are also obligated to clearly signpost smoking bans and ensure these rules are followed. Violations of the Law on Tobacco and Similar Products can result in sanctions such as fines. The law covers not only traditional tobacco products but also e-cigarettes and other non-combustible nicotine products, such as heated tobacco devices.
Smoke break during the workday
According to Swedish working hours legislation, you are allowed to work for a maximum of five hours straight before you have the right to take a break. During your break, you are not required to stay on the premises, which means you can leave the area and go to a place where smoking is permitted. The length of the break is not specified, but the Swedish Work Environment Authority recommends it should be at least 30 minutes.
Can employers ban smoking?
Employers can and, according to the law, must ban smoking in workplace areas. Therefore, the answer to whether you can smoke at work is no. However, they do not have the right to forbid you from smoking outside of the workplace during your break.
